Terms of use
The rules for using our website, apps, games and online services, and the limits of our responsibility.
Last updated 5 November 2026.
Please read these terms carefully. They explain the rules for using the TFY Apps website and every TFY Apps app, game, web app and online service, what you can expect from us, and the limits of our responsibility. The most important points about our responsibility to you are in the section Our responsibility for loss or damage.

1. Who we are
TFY Apps is the trading name of TFYDJC LTD, a company registered in England and Wales, company number 17532068, registered office 198 West End Lane, London, NW6 1SG ("TFY Apps", "we", "us", "our"). We are not registered for VAT.
You can contact us at info@tfyapps.com. Our website is https://tfyapps.com.
In these terms, "our products" means the TFY Apps website at tfyapps.com and its pages (including the app pages at tfyapps.com/apps), and every app, game, web app, tool and online service we make available, whether through Apple's App Store, Google Play, a web browser or otherwise.
2. Accepting these terms
By downloading, opening or using any of our products you agree to these terms. If you do not agree, please do not use our products.
Some products have extra terms that apply as well as these, for example the product sections in Terms for particular products below, the terms page for an app at tfyapps.com/apps/<app>/terms, the terms of a business service such as Seatly or Statement Analyser, and our Website and Hosting Services Terms for businesses that buy a website from us. If extra terms for a product conflict with these terms, the extra terms apply to that product.
If you use a product on behalf of a business or other organisation, you confirm that you have authority to accept these terms for it, and "you" includes that organisation.
3. Consumers and business users
Some of these terms apply differently depending on whether you are a consumer or a business user.
- You are a consumer if you are an individual using our products wholly or mainly for purposes outside your trade, business, craft or profession.
- You are a business user if you use our products for the purposes of a trade, business, craft or profession (including as a sole trader), or on behalf of a company or other organisation.
If you are a consumer, you have legal rights in relation to digital content and services that are not as described, not fit for purpose or not of satisfactory quality, and services that are not performed with reasonable care and skill. Nothing in these terms affects those legal rights. Advice about your legal rights is available from Citizens Advice.
4. Your licence to use our products
We grant you a personal, non-exclusive, non-transferable, revocable licence to use our products in line with these terms and, for apps, the rules of the store you got the app from. For consumers, this licence is for your own private, non-commercial use. Business users may use business products for their own internal business purposes, as set out in the terms for that product.
You must not, and must not help anyone else to:
- copy, sell, rent, lend, sub-license, distribute or publish any product or its content, except as these terms or the law allow;
- copy, decompile, reverse engineer or modify a product, except where the law allows you to do so and this cannot be excluded;
- remove or hide any copyright, trade mark or other notice;
- get around any technical measure in a product, including payment, subscription or access controls, or use a product to build a competing product.
5. Acceptable use
You must not use our products:
- in any way that breaks the law or any regulation, or that is fraudulent or harmful;
- to send, upload or share anything that is unlawful, defamatory, abusive, obscene, threatening, discriminatory or that infringes anyone else's rights, including their privacy or intellectual property;
- to upload viruses or other harmful code, or to try to gain unauthorised access to our products, our servers or anyone else's data;
- to overload, disrupt or interfere with our products, including by scraping or automated access we have not agreed to in writing;
- to send unsolicited marketing or to collect other people's personal data without a lawful basis.
If you break these rules we may suspend or end your use of the product concerned (see Suspending or ending your use) and, where the law requires or allows, report the matter to the relevant authorities.
6. Intellectual property
We, or the people who license material to us, own all intellectual property rights in our products and their content, including text, questions, explanations, designs, graphics, code, sounds and the TFY Apps name and logo. These rights are protected by copyright, database right, trade mark and other laws. You get only the licence described in these terms; no ownership passes to you.
Names of governments, official bodies, exam boards, qualifications, tests, football competitions, clubs and other third parties are used only to describe what a product is about. They belong to their owners, and using them does not mean that the owner is connected with, endorses or approves our products.
Where a product contains material published by a public body under an open licence (for example published official question lists or study materials), that material remains subject to its own licence, and we use it in line with that licence.
7. Our content: reasonable care, no guarantee
We take reasonable care in preparing the content of our products, and we correct mistakes when we find them or they are reported to us. However:
- our content is provided "as is" and for general information, learning and entertainment;
- we do not guarantee that it is accurate, complete or up to date, that it matches any official test, exam, syllabus or rule at the time you use it, or that it will give you any particular result, score, grade or outcome;
- rules, laws, official materials, test formats, exam specifications and other facts change, sometimes without notice, and our content may not yet reflect a change.
You are responsible for checking anything important against official or other reliable sources before you rely on it. This section does not take away your legal rights as a consumer if paid digital content is not as described, not fit for purpose or not of satisfactory quality.
8. No professional advice
Nothing in our products is legal, immigration, financial, investment, tax, accounting, medical, health or other professional advice, and nothing in them creates a professional relationship between you and us. Our products are not a substitute for advice from a suitably qualified professional who knows your circumstances, such as a solicitor or regulated immigration adviser, an accountant or tax adviser, a regulated financial adviser, or a doctor, midwife, health visitor or other healthcare professional. You should get such advice before making any important decision.
9. No official connection
Unless a product clearly says otherwise, TFY Apps and our products are independent. We are not affiliated with, authorised by, endorsed by or acting on behalf of any government, government department or agency, test provider, exam board, awarding body, regulator, school, sports league, club or other official body, including any body named in a product. Our products are not official tests, official practice materials or official sources of information, and using them is not part of any official application, test or exam process.
10. Subscriptions, in-app purchases and paid apps
Some products are free, some are paid for once, and some offer subscriptions or other in-app purchases. The price, what it includes, how long a subscription lasts and any free trial are shown in the app or in the store listing before you buy, in your local currency.
- Who takes payment. Purchases in our phone apps are made through Apple's App Store or Google Play and are billed by Apple or Google to the account you use with them, under their terms. We never see your card details.
- Automatic renewal. Unless the app says otherwise, a subscription renews automatically at the end of each period at the price shown when you subscribed (or a new price we have told you about in advance, as Apple or Google require), and you are charged by Apple or Google within the 24 hours before the current period ends, unless you turn off automatic renewal at least 24 hours before the end of the current period.
- Free trials. If a free trial is offered, its length is shown before you start it. Unless you cancel at least 24 hours before the trial ends, the paid subscription starts and you are charged when the trial ends. Any unused part of a free trial ends when you buy a subscription.
- Managing and cancelling. You can manage or cancel a subscription at any time in your Apple ID or Google Play account settings. If you cancel, you keep access until the end of the period you have already paid for, and the subscription will not renew. Deleting the app does not cancel a subscription.
- Price changes. We may change prices for future periods. Apple or Google will tell you about a price increase for a subscription in the way their rules require, and where required will ask for your agreement before it applies.
- Other services. Business services sold directly by us (for example Seatly, Statement Analyser or our website and hosting service) are billed under their own terms.
11. Cancelling and refunds
When you buy an app, a subscription or an in-app purchase through Apple or Google, cancellation and refunds are handled by Apple or Google under their own policies and the law. You can ask Apple for a refund at reportaproblem.apple.com, and Google through your Google Play order history. We cannot issue refunds for store purchases ourselves.
Your right to change your mind. If you are a consumer in the UK, you normally have 14 days to cancel a contract for digital content or a digital service bought at a distance. For digital content that is not supplied on a physical medium (such as an app, unlocked content or a subscription), you lose that right once the supply of the digital content has begun, if you have expressly agreed to it starting straight away and acknowledged that you will lose your right to cancel. Apple or Google ask for this agreement when you confirm a purchase. If the digital content is faulty, you keep your legal rights to a repair, a replacement or a refund, whatever happens to the right to change your mind.
Nothing in this section affects your statutory rights.
12. Apple App Store and Google Play
If you got an app from Apple's App Store, the following also applies and takes priority over anything in these terms that conflicts with it:
- These terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your licence is limited to using the app on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing where the app allows it.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any warranty that applies to it, you may notify Apple and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, to the extent set out in these terms.
- We, not Apple, are responsible for dealing with any claims by you or anyone else relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that the app or your possession or use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.
- Questions, complaints or claims about the app should be sent to us at the contact details in section 1.
- You must comply with any third-party terms that apply when using the app, such as your mobile data agreement.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
If you got an app from Google Play, Google Play's terms of service and policies also apply to your purchase and use of the app. Google is not responsible for the app.
13. Children's apps and parental responsibility
Some of our products are made for children, such as Starmark Junior, Pocket Money Street and Rainbow Promise. Others are for teenagers or adults. Each product's store listing and app page says who it is for.
- If you are under 18, you must have the permission of a parent or guardian to use our products and to make any purchase. Purchases in our children's apps are meant to be made by a parent or guardian, and some are behind a grown-ups check.
- Parents and guardians are responsible for deciding whether a product is suitable for their child, for supervising their child's use of devices and screen time, for any purchases made on their accounts, and for the parental controls on their devices and store accounts (for example Apple's Ask to Buy or Google Play's purchase approvals).
- Our children's apps contain no advertising. Where a children's app allows a child to type something to send to us, we ask children not to include personal details.
- Our learning products for children support, but do not replace, a child's school, teachers or parents.
14. Things you send us
If you send us a mistake report, feedback, a suggestion, a support email or other material, you confirm that you are entitled to send it and that it does not break the law or anyone's rights. You give us a free, worldwide, non-exclusive, perpetual licence to use it to run, correct and improve our products. We do not have to use it, and we will not identify you publicly without your permission. Please do not send personal details we have not asked for. How we handle personal data is explained in our privacy policies.
Business users who upload data to a business product (for example bank statements to Statement Analyser, or client records to Seatly) keep their rights in it, and the terms of that product explain how we use it.
15. Other websites and third-party services
Our products may link to, or work with, websites, apps and services run by others, such as Apple, Google, payment providers, official websites, maps, fonts, email and hosting providers. We provide those links and connections for convenience only. We do not control those services and are not responsible for their content, availability, security or privacy practices, or for any loss caused by your use of them. Your use of them is governed by their own terms and policies. A link does not mean that we endorse the linked service.
16. Availability and updates
We aim to keep our products working, but we do not guarantee that any product, or any part of it, will always be available, uninterrupted, secure or free from errors, bugs or viruses, or that it will work with every device, operating system or browser. Products may be unavailable from time to time, for example for maintenance, updates or reasons outside our control.
We may update or change our products, for example to fix problems, improve them, reflect changes in the law or official materials, or respond to security threats. Some updates may be needed for a product to keep working. If you are a consumer and a change we make to paid digital content or a paid service would negatively affect your access to or use of it more than in a minor way, we will tell you in advance, and you may have the right to end the contract and get a refund for any period you have paid for but not received.
We may stop offering a product. If we stop a product you have paid for in advance, we will give you reasonable notice where we can, and you will not lose any legal right to a refund for any period you have paid for but will not receive.
Use our products only on devices and software that are up to date and protected, and keep your own copies of anything important. You are responsible for your own internet access and any data charges.
17. Suspending or ending your use
You can stop using a product at any time. To end a subscription, cancel it as described in section 10.
We may suspend or end your access to a product, with notice where it is reasonable to give it, if you seriously or repeatedly break these terms, if we reasonably believe you are using it unlawfully or in a way that harms us or others, or if we are required to by law. If we end a paid product for a reason that is not your fault, we will make sure you receive any refund the law requires.
18. Our responsibility for loss or damage
18.1 For everyone
Nothing in these terms excludes or limits our liability for:
- death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors;
- fraud or fraudulent misrepresentation;
- any other liability that cannot be excluded or limited by law.
If you are a consumer, nothing in these terms affects your statutory rights, including your rights under the Consumer Rights Act 2015.
18.2 If you are a consumer
- We are responsible for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you started using the product, both we and you knew it might happen.
- Damage to your device. If defective digital content that we have supplied damages a device or digital content belonging to you, and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. We will not be responsible for damage that you could have avoided by following our advice to apply an update offered to you free of charge, or that was caused by you not following installation instructions or not having the minimum system requirements we told you about.
- We are not liable for business losses. Our consumer products are for domestic and private use. If you use them for any commercial, business or resale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
- Decisions you make. Because our content is for general information, learning and entertainment and is not professional advice (see sections 7 and 8), we are not responsible for the outcome of any test, exam, application or decision, except to the extent that loss is caused by our breaking these terms or failing to use reasonable care and skill and is foreseeable.
18.3 If you are a business user
This section applies only to business users, and is subject to section 18.1.
- Except as expressly set out in these terms or the terms for the product you use, our products are provided "as is" and "as available", and all warranties, conditions and other terms implied by statute, common law or otherwise are excluded to the fullest extent permitted by law.
- We will not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, misrepresentation or otherwise, for any: (a) loss of profit; (b) loss of revenue or sales; (c) loss of business, contracts or opportunity; (d) loss of anticipated savings; (e) loss or corruption of data or information; (f) loss of goodwill or damage to reputation; or (g) indirect or consequential loss, in each case however arising and even if it was foreseeable.
- Our total liability to you for all claims arising out of or in connection with our products and these terms, in any 12-month period, whether in contract, tort (including negligence), breach of statutory duty, misrepresentation or otherwise, is limited to the total amount you paid us for the product concerned in the 12 months before the event that gave rise to the claim or, if you paid us nothing in that period, £100.
- Where a business product has its own terms with a different limit, those terms apply to that product instead of the limit in this section.
- You must bring any claim against us within one year of the date on which you became aware, or ought reasonably to have become aware, of the facts giving rise to it, unless the law does not allow this time limit.
We think these limits are reasonable, taking into account the prices we charge, the nature of our products, the availability of insurance to you, and the fact that you are best placed to check our products' output and to protect your own data and business.
19. Business users' indemnity
If you are a business user, you will indemnify us, and keep us indemnified, against all losses, damages, liabilities, fines, costs and expenses (including reasonable legal fees) that we suffer or incur as a result of any claim by a third party, or any action by a regulator, arising from: your breach of these terms or of the terms of the product you use; your misuse of a product; any data, content or material you upload, send or ask us to use; or your breach of any law, including data protection and marketing laws. This does not apply to the extent the loss was caused by our own breach of these terms or our negligence. We will tell you promptly about any such claim and give you reasonable help, at your cost, in dealing with it. Consumers do not give this indemnity.
20. Terms for particular products
The sections below apply to the products named in them, as well as everything above. They do not reduce any legal right you have as a consumer.
20.1 Citizenship, naturalisation and settlement test apps
This section applies to our citizenship, naturalisation, residence and settlement test practice apps for the United Kingdom, the United States, Germany, Austria, France, Spain, the Netherlands, Denmark, Norway, Sweden, Canada and Australia, including Life in the UK Test Pass, US Citizenship Test Pass, Einbürgerungstest Pass, Staatsbürgerschaftstest Pass, Examen Civique Pass, CCSE Nacionalidad Pass, Inburgering KNM Pass, Indfødsretsprøven Pass, Statsborgerprøven Pass, Medborgarskapsprov Pass, Canadian Citizenship Test Pass and Australian Citizenship Test Pass.
- Not official. These apps are independent study aids. They are not official tests or official practice materials, and they are not run by, affiliated with or endorsed by any government or official body, including the Home Office or UK Visas and Immigration, US Citizenship and Immigration Services (USCIS), the German Federal Office for Migration and Refugees (BAMF), the Austrian Federal Ministry of the Interior or any Austrian state government, the French Ministry of the Interior, the Instituto Cervantes or the Spanish Government, DUO or the Dutch Government, SIRI or the Danish Government, HK-dir, UDI or the Norwegian Government, UHR or the Swedish Migration Agency, Immigration, Refugees and Citizenship Canada (IRCC) or the Australian Department of Home Affairs, or any official test provider.
- Questions. Where an official body publishes its questions, an app may contain those published questions. Where it does not, our questions are written by us from the official study materials and may differ from the questions in the real test. Official questions, answers, study materials, pass marks, test formats and rules change from time to time, and the app may not reflect a change straight away.
- No guarantee of passing. We cannot and do not promise that you will pass any test, or that a score in the app means you will pass. Your result depends on many things outside our control.
- Not immigration or legal advice. The apps do not tell you whether you are eligible for citizenship, settlement or any visa or status, what you must do to apply, or which test you need. Rules on eligibility, exemptions, fees and evidence are set by the relevant government. Always check the official government website for the country concerned, and get advice from a qualified and, where required, regulated immigration adviser or lawyer about your own situation.
- Booking. Book any test and make any application only through the official channels for the country concerned. We cannot book tests, and we have no influence over any test, application or decision.
20.2 Driving theory test apps
- Our driving theory test and hazard perception practice products are independent study aids. They are not run by, affiliated with or endorsed by the Driver and Vehicle Standards Agency (DVSA), the Driver and Vehicle Agency in Northern Ireland, or any government body, unless a product clearly says that it contains material used under licence from one of them.
- Practice questions and clips may differ from those in the real test. The real test, its rules and its pass marks can change.
- We do not promise that you will pass the theory test, the hazard perception test or the practical driving test. Practising with our products does not replace driving lessons or learning The Highway Code and the official materials. Book your test only through the official government service.
20.3 Revision and learning apps
This section applies to Starmark, Starmark Junior, Evenhand and our other learning products.
- These apps are independent learning and revision aids. They are not produced, endorsed or approved by any exam board or awarding body, by the Department for Education, by Ofqual or by any school. Names of exam boards, qualifications and specifications are used only to identify the course.
- We aim to follow the relevant specifications and curriculum, but specifications change, and the app may not cover every topic or reflect every change. Always check the current specification from the exam board and follow the guidance of your teacher or school.
- We do not promise any grade, mark, score or exam result.
- Where a product presents different views on debated topics (as Evenhand does), presenting a view or argument is not an endorsement of it, and statistics are shown with their sources and dates as at the time we checked them.
20.4 Statement Analyser
- Statement Analyser is a tool for businesses, sole traders, bookkeepers and accountants. It reads bank statements you upload and produces categorisations, checks, reports and export files for information only.
- It is not financial, accounting, tax, legal, lending or audit advice, and it does not replace a qualified accountant or adviser. Automated reading and categorisation can make mistakes, especially with unusual statement layouts or poor quality files.
- You are responsible for the data you upload (including having the right to upload it), for checking every figure and categorisation against your bank's own records before you rely on it, and for your books, tax returns, filings, lending applications and business decisions. Check with a qualified adviser before relying on the output for anything important.
- The Statement Analyser terms of service at statement.tfyapps.com/terms also apply.
20.5 Capital Allowances Tool
- The Capital Allowances Tool gives general information and illustrative calculations about UK capital allowances based on the figures you enter. It is not tax, accounting or legal advice and does not take account of your full circumstances.
- Tax law, rates, allowances and HMRC practice change, and whether an allowance is available depends on facts the tool cannot check. Results may be incomplete or wrong for your situation.
- You are responsible for the figures you enter and for any claim, return or decision you make. Check with a qualified tax adviser or accountant, and with HMRC guidance, before making any claim. The tool is not connected with or endorsed by HMRC.
20.6 Baby care and health-related apps
This section applies to Nightlight Baby (also referred to as our baby tracker) and any other product that lets you record or view health-related information.
- These products are logs and organisers for parents and carers. They are not medical advice, they do not diagnose, monitor, treat or prevent any condition, and they are not medical devices. They do not alert you to any health problem or emergency, and they are not a baby monitor or a safety device.
- Any general information, summary or chart in the product is not a substitute for advice from a doctor, midwife, health visitor, pharmacist or other healthcare professional.
- If you are worried about your baby's or anyone's health, feeding, sleep or development, contact your GP, midwife or health visitor, or call NHS 111. In an emergency, call 999 (or your local emergency number if you are outside the UK).
- Records you keep are saved where the product says (for example only on your device). Keep your own copy of anything important; we cannot recover records that are stored only on your device if they are lost.
20.7 Games
This section applies to Mapnado, Neon Mini Games, our party games, Skyport, Grand Stay, Wild Acres and our other games.
- Our games are for entertainment only. They involve no gambling or betting, and you cannot win money or prizes unless the game clearly says otherwise in a separate set of competition rules.
- Coins, cash, scores, stars, levels and other items in our games are virtual, have no real-world value and cannot be exchanged for money or anything else.
- Facts in quiz games (such as countries, capitals, flags and borders) are simplified for the game. Some borders, names and territories are disputed; how a game shows them is not a statement of any political position and is not authoritative.
- For party and physical games, play safely and sensibly, choose a suitable space, and make sure everyone playing is happy to take part. Parents and guardians should supervise children.
20.8 Prem Six and other prediction or guessing games
- Prem Six and any other prediction or guessing game we offer are entertainment only. They are not gambling or betting products and offer no money or prizes unless clearly stated otherwise in separate competition rules. Any price you pay is for the game itself, not a stake on any outcome.
- Football, player, club and competition names and facts are used only to describe the game. Prem Six is not affiliated with, authorised by or endorsed by the Premier League, the Football Association or any club or player. Player facts may be incomplete or out of date.
20.9 Seatly, Shogo booking and other booking products
- Seatly is software for businesses, provided under the Seatly terms of service, which apply as well as these terms.
- Where you book an appointment with a salon or other business through a booking page we run for it (such as the Shogo booking page), your contract for the appointment and its services is with that business, not with us. That business is responsible for its services, prices, cancellation policy and deposits. We only provide the booking software and are not responsible for the services the business provides.
20.10 Website and hosting services
Businesses that buy a website, hosting or related services from us are bound by our Website and Hosting Services Terms, which apply instead of sections 10 and 11 of these terms for those services.
21. Preview pages
We sometimes make a personal preview page to show a business what a website from us could look like. A preview page is a concept design only. It may contain example text, example images, example prices, opening hours and other placeholder content, which are illustrations and not statements of fact about the business, and it may use the business's name or publicly available details only to show the concept. A preview page is not the business's website, is not an offer that the business must accept, and creates no obligation on either side. If you are the business shown and want a preview page removed, email info@tfyapps.com and we will take it down.
22. Privacy
We use personal data only as described in our privacy policies: the website privacy policy, the cookie policy, and the privacy policy for each app at tfyapps.com/apps/<app>/privacy. We send marketing messages only where the law, including the Privacy and Electronic Communications Regulations, allows, and you can unsubscribe at any time.
23. Changes to these terms
We may change these terms from time to time, for example to reflect changes in the law, in our products or in how we do business. The "last updated" date at the top shows when they last changed. If a change is significant and affects a product you pay for, we will tell you in advance by a notice in the product, on this page or by email where we have your address. If you are a consumer with a paid subscription and you do not agree to a significant change, you can cancel before it takes effect. The terms that apply to a purchase are those in force when you made it, except for changes the law requires or that do not disadvantage you.
24. Other important terms
- Transfer. We may transfer our rights and obligations under these terms to another organisation, and we will make sure this does not affect your rights under these terms. You may not transfer your rights or obligations without our written agreement.
- Third parties. Except for Apple and its subsidiaries as stated in section 12, no one other than you and us has any right to enforce these terms, under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
- Each section stands alone. If a court decides that any part of these terms is unlawful or unenforceable, the rest of the terms will continue in full force.
- Delays in enforcing. If we do not insist straight away that you do something you are required to do under these terms, or if we delay in taking action, that does not mean we have given up our rights and does not stop us taking action later.
- Events outside our control. We are not responsible for delay or failure caused by events outside our reasonable control, such as failures of the internet, power, Apple, Google or hosting providers, cyber attacks we could not reasonably prevent, extreme weather, strikes or government action. If this affects a paid product, we will tell you and do what we reasonably can to reduce the effect.
- Whole agreement for business users. For business users, these terms and the terms for the product used are the whole agreement between us about their subject matter, and you have not relied on any statement that is not in them. This does not limit liability for fraud or fraudulent misrepresentation.
- Translations. We may provide summaries or translations of these terms. If there is any conflict between a translation and this English version, this English version applies, to the extent the law of the country where you live allows.
25. Law and courts
These terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or our products, are governed by the law of England and Wales.
- If you are a consumer, you can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in either the Northern Irish or the English courts.
- If you are a consumer living outside the UK, you also keep the protection of any mandatory consumer laws of the country where you live, and you may be able to bring proceedings in the courts of that country where its law allows. Nothing in these terms takes away those rights.
- If you are a business user, the courts of England and Wales have exclusive jurisdiction.
