Nightlight Baby terms of use
The key terms for using Nightlight Baby. They add to the full TFY Apps terms of use, which also apply, including the section on baby care and health-related apps. By downloading or using Nightlight Baby you agree to both.
Who we are
Nightlight Baby is made by TFY Apps, the trading name of TFYDJC LTD, a company registered in England and Wales, company number 17532068, registered office 198 West End Lane, London, NW6 1SG. Contact us at info@tfyapps.com.
Not medical advice
- Nightlight Baby is a log and organiser for parents and carers. It is not medical advice, it does not diagnose, monitor, treat or prevent any condition, and it is not a medical device, a baby monitor or a safety device. It does not alert you to any health problem or emergency.
- Any summary or chart in the app is not a substitute for advice from a doctor, midwife, health visitor, pharmacist or other healthcare professional.
- If you are worried about your baby's health, feeding, sleep or development, contact your GP, midwife or health visitor, or call NHS 111. In an emergency, call 999 (or your local emergency number outside the UK).
- What you log is saved where our privacy policy says. Keep your own note of anything important: we cannot recover records that are stored only on your device if they are lost.
Paying
If Nightlight Baby costs money, or offers anything to buy inside it, you pay Apple or Google through the App Store or Google Play, and the price is shown before you buy. We never see your card details. If a subscription is offered, it renews automatically until you cancel it in your App Store or Google Play account settings, as explained in the full terms.
Cancelling and refunds
Purchases are made through Apple or Google, so cancellations and refunds are handled by them under their own policies and the law: request a refund at reportaproblem.apple.com or through your Google Play order history.
As a consumer in the UK you normally have 14 days to change your mind about digital content bought online, but you lose that right once the download or access begins if you agreed to it starting straight away and acknowledged that you would lose the right to cancel. Apple or Google ask for this when you buy. If Nightlight Baby is faulty, you keep your legal rights to a repair, a replacement or a refund. Nothing in these terms affects your statutory rights.
Using Nightlight Baby
If you are under 18, ask a parent or carer before buying anything.
Nightlight Baby is for your own personal, non-commercial use. Please do not copy, resell or share its content outside the app, or try to get around its payment or access controls.
Our responsibility to you
We take reasonable care with Nightlight Baby, but it is provided as it is, and we do not guarantee that it is always available, free of errors, complete or up to date, or that it will give you any particular result.
If Nightlight Baby or its content is faulty you have rights under the Consumer Rights Act 2015, and nothing in these terms limits them. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for business losses. If defective digital content we supply damages your device or other digital content because we did not use reasonable care and skill, we will repair the damage or pay you compensation.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to exclude or limit.
Changes
We may update these terms, for example when the law or the app changes. We will update this page and the date above, and tell you in the app about any significant change. If you pay for a subscription and do not agree to a significant change, you can cancel before it takes effect.
Law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you can also bring a claim in your local courts. If you live outside the UK, you keep the protection of the mandatory consumer laws of the country where you live, and you may be able to bring a claim in its courts where its law allows.
